Scammers are looking for attorneys, but not for representation. Seven out of every 10 law firms in the United States are, at one time or another, targeted by criminals using electronic means to defraud firms of thousands of dollars or more. The most common form of wire fraud is typically perpetrated via Business Email Compromise (BEC). According to Reuters, the number of global BEC fraud cases rose from 22,132 in 2016 to more than 40,000 in 2017. Nearly 23,000 of those 2017 BEC wire fraud investigations involved U.S. targets.

Over the thirty years or so that I have represented lawyers, I have heard on many occasions that the trial judge made a mistake of law, and it was the judge’s error that caused the harm which forms the basis of the former client’s lawsuit against them. Texas, like many states has remained quiet on this point, until recently. Fortunately, for the lawyers in Texas there is now more hope that we can potentially argue in some situations, that the court’s legal error was what caused the client’s injury.
